《劳动合同法》中用工合同签订的解读分析

一、劳动合同   the labor contract

用人单位与劳动者直接签订全日制劳动合同或非全日制劳动合同。

The employer and the worker directly entered into full-time labor contract or part-time labor contract.

(一)全日制劳动合同  full-time labor contract

1、主体资格:用人单位具有独立法人资格及相应业务资质等;劳动者符合法定年龄要求、身体健康、具备劳动能力,且能从事全日制工作,还未享受社会保险待遇;

2、工作内容:劳动者的工作内容是用人单位业务的组成部分;

3、用工管理:劳动者需遵守用人单位依法制定的各项劳动规章制度,接受用人单位的劳动管理,从事用人单位安排的有报酬的劳动。

1, the subject qualifications: the employer has independent legal personality and business qualifications; workers meet the legal age requirements, have good health condition, possess working ability, can work full-time and not yet enjoy social insurance benefits;

2, working content: the working content of the workers is an integral part of the business of the employer

3, the employment management: the workers should comply with the labor rules and regulations established by the employer according with the law, accept the employer's labor management, and do the gainful work arranged by the employer.

(二)非全日制劳动合同 part-time labor contract

1、主体资格:用人单位具有独立法人资格及相应业务资质等;劳动者符合法定年龄要求、身体健康、具备劳动能力,还未享受社会保险待遇;

2、工作时间:劳动者在同一用人单位一般平均每日工作时间不超过四小时,每周工作时间累计不超过二十四小时;

3、用工管理:签署非全日制劳动合同,工资标准以小时计算(不得低于当地公布的非全日制用工最低小时工资标准),不得约定试用期,应缴纳工伤保险,不缴纳其他社会保险及住房公积金,劳动报酬结算周期最长不超过15天;双方可以随时终止合同。

1, the subject qualifications: the employer has independent legal personality and business qualifications; workers meet the legal age requirements, have good health condition, possess working ability, can work full-time and not yet enjoy social insurance benefits;

2, hours of work: worker’s average daily working time in one employer is generally not more than four hours, and the weekly working hours accumulated should not over twenty-four hours;

3, employment management: sign part-time labor contracts, the wage standard is based on hours (not less than hourly wage standard of part-time employment published by the local minimum), probation period is not applicable, work-related injury insurance should be paid, other social insurance and housing funds are no need, labor compensation settlement period is no longer than 15 days, parties may terminate the contract at any time.

二、劳务派遣合同   labor dispatch contract

1、主体资格:劳动用工单位具备独立法人资格及相应业务资质等;劳务派遣单位具备法定的劳务派遣资质、注册资金、营业执照等,并与劳动者已签订劳动合同;

2、工作性质:劳务派遣单位与劳动者签订劳动合同,将劳动者派遣到用工单位从事临时性、辅助性、替代性工作的特殊劳动关系;

3、用工管理:用工单位与劳务派遣单位签订劳务派遣合同,劳务派遣员工与用工单位之间无劳动关系;用工单位不得与劳务派遣员工签订《岗位聘用协议》、《岗位职责协议》、《培训协议》等,不能直接向派遣员工下发《续签合同通知》、《解除用工关系通知》等。

1, the subject qualifications: the employer has independent legal personality and business qualifications; labor dispatch units have statutory dispatch qualification, registered capital, business license, and sign labor contracts with workers

2, the nature of the work: labor dispatch units sign labor contract with workers and send workers to labor units to engage in temporary, auxiliary, alternative work

3, employment management: labor units sign labor dispatch contract with labor dispatch unit, the dispatched workers have no employment relation with labor units. The labor units  should not sign "position employment agreement" "job responsibilities agreement", "training agreement” with dispatched workers, and should not issue “renew the contract notice "," notice of termination of employment "directly to the dispatch workers.

退休返聘

Retirement employment

已享受社会保险待遇(含离休、退休、提前退休、病退、退养,不含内退、下岗、待岗、停薪留职)。

Enjoy social insurance benefits

签署《退休返聘合同》,明确工作时间、工作任务及因工受伤的处理、合同的解除条件及违约责任。因工受伤,按照《工伤保险条例》的规定处理,应购买意外伤害保险。

Sign "Retirement Employment Contract”, clear working time, working tasks and work-related injuries compensation, the release conditions of the contract and the liability for breach. Work-related injuries compensation could be treated in accordance with the "Work Injury Insurance Regulations" and the accident insurance should be bought.

学生实习

Student internship

未从学校毕业(领取毕业证)学生,提前到用人单位从事相关工作

Students who not graduate from school (to receive a diploma) engage in related work in employer in advance

签署《实习协议》,明确实习期间、实习任务、实习报酬、意外伤害的处理等,与用人单位之间不属于劳动关系,不受《劳动合同法》约束,应购买意外伤害保险。

Sign the internship agreement, clear the internship period, internships compensation, accident processing. There is no relationship between the employer and the student, and not subject to the" Labor Contract Law”. The accident insurance should be bought.

外籍就业

Foreigner employment

非中国大陆公民,包括外籍、港澳台居民和无国籍人

Non-mainland Chinese citizens, including foreigner, Hong Kong, Macao and Taiwan residents and stateless persons

(1)具备《居留许可证》和《就业证》,用人单位应与其签订劳动合同,缴纳社会保险,离职后,应及时注销《就业证》;

(2)尚无法办理《就业证》的特例,用人单位应与其签订劳务合同,缴纳意外伤害保险和疾病保险。

(1) Own "residence permit" and "employment permit”, the employer should sign labor contracts and pay social insurance. "Employment permit” should be promptly canceled after the departure of the worker;

(2) For the special case without the "employment permit”, the employer should sign service contracts with them and pay accident insurance and sickness insurance.
